GENERAL CONDITIONS OF THE BITTER CLUB CARD

3. USE OF THE BITTER CLUB CARD
The Amarga Club card is a digital club card that allows you to track certain activities, entitling the cardholder to a series of potential rewards and exclusive benefits. Therefore, the Amarga Club card is personal and non-transferable, and improper use will result in its revocation by the establishment.

We reserve the right to verify the identity of any participant in any circumstance related to the Program (for example, purchases, exchanges or returns, accrual and/or redemption of points, application of associated benefits, etc.). In physical stores, participants may be asked to identify themselves through their personal information (for example, email, mobile phone number, and/or first and last name) or through their Card ID (barcode), which may be displayed on their digital membership card (welcome email, web card, or mobile wallet versions of the digital card).

A participant will only be considered a valid cardholder if their membership is still active and has not been cancelled.

The card is the property of the issuer and can be revoked by the issuer unilaterally.

4. ACTIVITIES ASSOCIATED WITH THE BITTER CLUB CARD

• Use the Amarga Club Card for in-store purchases and have them recorded.

• Install the Amarga Club Card in your mobile wallet.

• Earn 10 points for every euro of purchases made within the periods outlined in these Terms and Conditions to convert them into a points balance and qualify for rewards associated with these purchases.

• Receive additional communications and personalized content if you have given your consent to do so

5. BENEFITS OF THE BITTER CLUB CARD WITH OTHER PRODUCTS AND SERVICES

Being part of the Program will have the following benefits ("Benefits"):

6. Discount coupons . Generation of promotional coupons with absolute or percentage value for in-store purchases.
7. Promotions . Some product promotions in Physical Stores, such as product giveaways, may be available only to participating customers. If promotional stock runs out, Amarga Vintage may substitute gifts of equal or greater value and similar features.
8. Personalized vouchers . Participants who use their card for purchases can receive coupons based on their purchasing habits, such as frequency, frequency, value, or specific content.
9. Exclusive Activities. Participants may be invited to participate in exclusive activities not open to the general public.

6. CONDITIONS OF THE AMARGA CLUB CARD, ACTIVITIES AND ADVANTAGES CLAUSES.

First. Any individual who is at least 18 years of age at the time of joining the Program may join the Amarga Club Card.

Second. Rewards may not, under any circumstances, be transferred to third parties. They will have a default expiration date indicated in each offer, and if this period elapses without being redeemed, they will automatically expire. Exceptionally, some Rewards may be valid for the purchase of a specific collection of products or at a specific time. If applicable, this validity will be clearly communicated to the customer at the time of issuance.

Third. Once a participant has redeemed the Rewards, they will be automatically deactivated. Participants who use their Amarga Club Card for purchases may use some of the Rewards awarded on those purchases if they meet the Individual Benefit criteria. To redeem some Rewards, participants must meet the Individual Benefit criteria at the time of issuance (such as, but not limited to, Birthday or Newsletter Subscription). Additionally, other Benefits (such as discounts) require a prior purchase, which may or may not include a minimum purchase value to be applicable, as specified in the reward.

Participants may redeem their prizes in person at the physical store located at Calle Meléndez, 5, 37002, Salamanca. In any case, rewards cannot be exchanged for cash and are non-refundable. Under no circumstances will any prizes be shipped or delivered remotely.

Fourth. Without prejudice to the provisions of the preceding sections, the following general operating rules apply to the accumulation and redemption of Rewards:

1. Selling, trading, or exchanging Club Amarga Card vouchers or points is not permitted.
2. Rewards included in the Program are subject to change.
3. Every euro spent on the final purchase receipt is worth 10 points. If the purchase is for a discounted item, the points earned will be based on the final receipt and not on the original price of the item(s).
4. Rewards applied to in-store purchases are non-cumulative and can only be applied to active prices at the time of the Reward redemption in that physical store. Therefore, points can be redeemed for each order and purchase.
5. Personalized gift vouchers can be used for payment above a certain minimum purchase amount, taking into account the final retail price (VAT included). If the amount of the personalized gift voucher does not cover the final retail price (VAT included), participants must pay the difference, which can only be done using the available payment methods. If the personalized gift voucher is worth more than the amount ordered, the difference is non-refundable and cannot be carried over to a subsequent order. Therefore, if the participant does not use the full value of the promotional voucher on their order, they will forfeit the difference.
6. It may not be possible to accumulate purchases and redeem Benefits during sales or promotional periods.
7. We do not guarantee the availability and continued operation of the Program when technical reasons (e.g., system, server, computer equipment, or Internet failures) or force majeure prevent this, and therefore we will not assume any liability for any damages that may arise from the lack of continued operation of the Program. However, whenever possible, we will do everything possible to notify the participant of such incidents.

Fifth. In the case of returns and/or exchanges of Products purchased through the accumulation and/or redemption of Rewards (especially in the case of gift certificates/personalized vouchers), since these are for single use only, Amarga Vintage will adjust them as follows:

In the event of a return of the product(s), the redeemed points will not be returned to the participant's Amarga Club Card, and the voucher issued with the refund value will not include the amount equivalent to the redeemed points.

If, as a result of a return or exchange, the participant receives a refund, it will always be for an amount equal to the original purchase and the Reward cannot be converted into cash.

Sixth. The Program enters into force on May 27, 2024, and has no fixed end date. Amarga Vintage reserves the right to cancel or modify the Program Terms at any time. Modification or cancellation of the Program Terms will not entitle the participant to any compensation.

Seventh. Termination of Amarga Vintage's participation in the Program, whether due to fraud or any other reason, entails the waiver of all rights and benefits, including, but not limited to, gifts, vouchers, promotions, unexpired points, or the cardholder's accumulated balance.

Participants may unsubscribe from the Program and, consequently, process their withdrawal as a user by sending an email to info@amargavintage.com. The withdrawal process can take up to 15 days. Once the withdrawal is processed, participants waive all rights and benefits, including, but not limited to, gifts, vouchers, promotions, points, or the balance accumulated by the cardholder, with no possibility of subsequent recovery.

Likewise, the participant will be automatically removed from the Amarga Club Card and, consequently, will waive all rights and Rewards, including, but not limited to, gifts, vouchers, promotions, points, or any accumulated balance that has not expired.

Eighth. The Amarga Club Card and the required documentation will only be validated by store staff (presentation of a degree certificate or official identification document is required to verify the customer's ID).

Ninth . The compensation system is implemented by accumulating 10 points for every euro of the net purchase amount the customer makes. Therefore, the amount accumulated in the form of points can be converted into discount coupons.

Tenth . Conditions for accumulating balance or points:

1. Customers with their Amarga Club digital card will be able to begin accumulating points on their purchases starting May 27, 2024.
2. Points will be accumulated whenever the purchase in question exceeds €1 and is made in a physical store.
3. Points will always be accumulated based on the net amount (with discounts applied and/or other applicable conditions), indicating the final value paid by the customer.
4. The points accumulation system consists of valuing each net euro (€) spent by the customer as equivalent to 10 cumulative points.
5. The balance resulting from the transformation of points will always be rounded, forming a round number.
6. It is not possible to accumulate points balance on online purchases.

Eleventh . Coupon redemption conditions:

1. Available prizes or rewards can be found in the Amarga Club Card Rewards catalog.
2. Once you have earned the required number of points to obtain Rewards, you can redeem them in a physical store.
3. When redeeming the Reward, the number of points used must be used in a single purchase and taking into account the Reward conditions (minimum purchase amount, product group, etc.).
4. The discount percentage obtained in the Rewards Program is for single use only and can be redeemed on a single purchase. In the event of a partial or full refund for a purchase with a discount percentage applied, the refund amount will be the net amount paid by the customer, including the discount applied. The discount can never be reinstated as it is for single use only.

The customer has the right to decline the prizes offered. This promotion does not apply to online purchases.

7. PROCESSING OF PERSONAL DATA

8. APPLICABLE LEGISLATION AND JURISDICTION

These General Conditions shall be governed by the local law applicable to each participant in the Territory. For the resolution of any dispute that may arise from the interpretation and/or execution of these Conditions, and unless required by applicable local law, Amarga Vintage and the participant expressly waive any other jurisdiction to which they may be entitled, and submit to the jurisdiction of the Courts and Tribunals of Salamanca, Spain.

The foregoing is without prejudice to the jurisdiction of the courts and tribunals of the consumer's domicile in the event that the user has the status of consumer according to the legislation in force at any given time.

Nothing in this clause shall affect the rights granted to the user as a consumer under applicable law.

9. FRAUD

Amarga Vintage reserves the right to take any action it deems appropriate if it detects fraudulent or suspicious behavior by participants who are not making proper use of the Benefits offered by the Program.
